Now that President Biden has directed OSHA to issue an Emergency Temporary Standard (ETS) that requires employers with at 100 employees to mandate their employees get vaccinated for Covid-19 or be subject to weekly testing, employers across the country are speculating on the what’s, when’s, why’s and how’s of this anticipated OSHA order.

In the brief update on Tuesday, Brad Adler with Freeman Mathis & Gary, LLP will spend a few minutes discussing where we are on this issue and discuss some of the most pressing questions employers have raised, including:

  1.  What type of workers does the ETS apply to (e.g., does it apply to remote workers?)
  2. How long will the ETS last?
  3. How do you calculate the 100 employee threshold?
  4. Will employers be required to collect proof of vaccination?
  5. What type of testing will be mandated?
  6. Who pays for the testing?
  7. Will there be a medical or religious exemption?
