Navigating the FMLA: Considerations Post-Pandemic

The FMLA is technical and difficult to understand – even without the added pressure of a global pandemic. During our presentation, we will discuss how COVID-19 has affected employee leave, beginning with a refresher on the FMLA and ADA. We will discuss the interaction between the FMLA and temporary, COVID-specific legislation. Then, we will answer the FMLA questions most HR professionals have encountered during the pandemic, including:

  • When am I required to provide leave?
  • Is fear of exposure a qualifying reason for leave?
  • What medical documentation can I request?
  • Is quarantine covered under the FMLA?

Finally, we will examine the recent trends in COVID related litigation under the FMLA and ADA.
